What does the certificate say about the diamond grade. Sounds like your stone is I1 to I2 clarity, most likely the latter. If the diamond grade is innaccurate the courts will require they replace it with the quality stated on the certificate. Take it to a reliable appraiser and get there opinion of the quality of the stone compared to the certificate. If significantly different (likely) you have a suit against them. Try to settle out of court.
In regards to ring sizing it seems it is the job of the jeweler to provide you the correct size and should not affect your right to return.
Be polite with the jeweler and negotiate. If this doesnt work small claims is a good option although it is limited to a certain amount depending on the State you live in. Indiana is $3500.
